Barry S. Feigenbaum

Barry S. Feigenbaum is a partner in the firm's business, corporate and commercial law and bankruptcy and reorganization groups. He handles various types of commercial transactions, bankruptcy matters and out-of-court debt restructurings. Mr. Feigenbaum has represented numerous borrowers in financing transactions and debtors restructuring their businesses in the U.S. Bankruptcy Court. He has significant experience in the sale and acquisition of operating businesses through the bankruptcy process and representing secured lenders in bankruptcy and foreclosure proceedings. He also represents real estate developers in the acquisition, financing and sale of commercial real estate projects. Mr. Feigenbaum has lectured on bankruptcy and debt restructuring. He has been designated a New England Super Lawyer, has held an AV rating from Martindale Hubbell for more than 20 consecutive years and is a fellow of the Connecticut Bar Foundation. Mr. Feigenbaum had served as Co-Chairman of the Commercial Law Committee, Hartford County Bar Association. He is a member of the Turnaround Management Association Connecticut Chapter. Also, Mr. Feigenbaum is on the Executive Committee of the Connecticut Bar Association Commercial Law and Bankruptcy Committee.

Experience

Prior to joining the firm in 1989, Mr. Feigenbaum was the Associate General Counsel of Coleco Industries, Inc., formerly a New York Stock Exchange Fortune 500 company, where he represented that company on various financial and corporate matters. He also has prior experience in private practice representing companies in financial matters.

Sample Engagements:

  • Represented a New England specialty retail chain in its Chapter 11 proceedings. Successfully managed the sale of the company's operations through the Bankruptcy Court and appointed as Plan Administrator by the creditors.

  • Represented a European purchaser of a bankrupt Connecticut manufacturer. Managed the process of formulating the offer, getting creditor and Bankruptcy Court approval, establishing the purchasing entity and closing the transaction.

  • Represented a Connecticut manufacturer in the resolution of numerous product liability cases through the Bankruptcy Court by establishing a mediation process which resulted in a successful Plan of Reorganization whereby the company emerged from Chapter 11.

  • Represented a real estate investor in the purchase and sale of a major recreational facility through the purchase of distress debt.

  • Represented a national bank in the Colonial Realty Bankruptcy and related cases, including successfully realizing on the lender's collateral which consisted of real estate projects and partnership interests.

  • Represented the Connecticut Bar Association and the National Association of Consumer Bankruptcy Attorneys in a challenge to various provisions of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 in the United States District Court and the United States Court of Appeals for the Second Circuit.


  • Education

    Mr. Feigenbaum is a graduate of The George Washington University (B.B.A. Accounting, with distinction, 1978) and University of Connecticut School of Law (J.D. with honors, 1981).
